1. Who operates ApexCast and these Terms
ApexCast is an independent racing commentary product operated from New York, United States. “ApexCast,” “we” and “us” refer to its operator. These Terms cover the website, desktop application, account services and paid features. Contact help@apexcastai.us with questions. We keep versioned records of your acceptance. When a new policy version requires acceptance, account access pauses until you review it and confirm. You can sign out if you do not agree. For users aged 16–17, a parent or legal guardian must complete the guardian declaration. By confirming acceptance when creating or accessing an account, you agree to these Terms. If you do not agree, do not create an account or use the account services. Our Privacy Policy explains how personal information is handled; acknowledging it is not blanket consent to unrelated processing.
2. Eligibility and accounts
You must be at least 16 to create an account or use ApexCast services. If you are 16 or 17, your parent or guardian must approve your use, and purchases must be made or authorized by a parent or guardian. You must also meet any additional requirements imposed by applicable law. Give accurate account information and keep credentials secure. Contact support promptly if you suspect unauthorized access. You are responsible for your own authorized account activity; this does not make you responsible for failures caused by us.
3. The service and software license
ApexCast processes supported racing-game context to generate commentary and related experience features. Subject to these Terms, we grant a limited, non-exclusive right to install and use the software for its intended functions. You do not receive ownership of our software, brand or underlying provider assets. Third-party and open-source components remain subject to their applicable licenses. ApexCast is independent and is not affiliated with Formula 1 or the FIA.
4. Commentary and beta features
Generated commentary may contain errors, incomplete interpretations or delays. Use it as an entertainment feature, not as an official race-control, regulatory, financial or safety-critical source. Compatibility and performance depend on the supported game, version, hardware and network conditions. Beta and features marked in development may be unreliable or change. Keep copies of recordings or content important to you.
5. Subscriptions and recurring billing
Paid subscriptions are processed through Stripe. Review the price, currency, included allowance and billing frequency displayed before purchase. A recurring subscription renews and charges the authorized payment method at the selected frequency until cancelled. Use the billing portal available from your account to manage or cancel it, and retain cancellation confirmation. The portal states when cancellation takes effect. Contact help@apexcastai.us if cancellation is unavailable or you cannot confirm it. Uninstalling the app or clearing local files does not cancel billing. Cancel recurring billing before deleting an account and contact support about any unresolved charge. We will give notice of material subscription changes as required by law; changes do not override existing statutory rights.
6. Voice credits and generated audio
Plan credits reset to the stated allowance at renewal; unused plan credits do not roll over. Purchased credits are used after plan credits and do not expire. Credits are consumed when new audio is generated, including prefetched audio that is never played. Replaying available cached audio does not consume additional credits. Credits are a service balance, not cash or an investment. Keep billing receipts and contact support about duplicate charges, failed generation or an incorrect balance. A billing error or service failure is not resolved merely by describing a feature as beta.
7. Refunds and mandatory consumer rights
For a refund request, an unauthorized or duplicate charge, or paid features that were not supplied as described, contact help@apexcastai.us with the account email and transaction reference. Do not email full card details. Requests are reviewed against the purchase terms and applicable law. Any refund terms shown before purchase must be read together with these Terms. Nothing here excludes a refund, cancellation, warranty or other remedy required by law, including mandatory rights that apply where you live.
8. Third-party services
Authentication, payments, voice generation, hosting and email rely on third-party services. Their availability and terms can affect service delivery. When you use an external service directly, its own terms may apply. A provider outage can interrupt ApexCast, but it does not automatically remove our responsibilities to you under applicable law.
9. Acceptable use
Do not access accounts or systems without permission, interfere with reliability, evade payment or entitlement checks, distribute credentials, abuse support, or use the service for harassment, fraud, unlawful impersonation or infringement. Do not remove required notices or bypass security controls. These restrictions do not limit rights that applicable law or an open-source license expressly grants.
10. Race data, recordings and content
You retain any rights you have in the content you provide. You authorize us to process, transmit and store it only as needed to supply the requested service, maintain its security and provide support, as described in the Privacy Policy. Ensure you have permission to provide participant information and other content. Recordings, game material, voices and generated output can involve third-party rights; these Terms do not grant rights that we do not own. This service-use authorization does not grant us permission to publish your private support reports or recordings as advertising.
11. Privacy and account deletion
The Privacy Policy describes data categories, provider roles, retention and request methods. Account deletion is available for eligible customer accounts. Some billing, security, support or legally required records may remain, and deletion does not erase copies on your device or copies you shared. Subscription cancellation and deletion are separate actions. Contact support for privacy requests or if billing continues after a cancellation request.
12. Availability and service changes
We do not promise uninterrupted access or compatibility with every title or device. We may change features for maintenance, compatibility, security or legal reasons. Where a material change or discontinuation affects a paid service, we will provide notice and any remedy required by applicable law. Changes do not retroactively extinguish mandatory consumer rights or our obligations concerning an existing purchase.
13. Suspension and termination
We may restrict access where reasonably necessary to address a breach of these Terms, fraud, security threats or legal requirements. Where practicable and appropriate, we will explain the reason and provide a support route to resolve it. Immediate action may be needed for urgent risks. Contact support to dispute an action or resolve subscription and credit issues. Suspension does not eliminate remedies required by law.
14. Feedback
You may send suggestions voluntarily. We may use general product suggestions without payment unless separately agreed. This does not transfer ownership of your private recordings or waive privacy rights in support submissions.
15. Disclaimers and responsibility
To the extent permitted by law, the service is provided as available without promises of error-free commentary or uninterrupted operation. We do not exclude mandatory warranties or consumer protections. You remain responsible for unlawful misuse and for obtaining permissions needed for content you provide. We remain responsible to the extent required by applicable law.
16. Limits on liability
To the extent permitted by law, we exclude liability for indirect or consequential losses arising from service use. This exclusion does not apply where it is prohibited or to fraud, deliberate misconduct, gross negligence, or other liability that cannot lawfully be excluded. Nothing in these Terms prevents remedies that mandatory consumer law gives you. No liability limit in these Terms overrides such rights.
17. Governing law
New York law governs these Terms except to the extent mandatory law requires otherwise. If you are a consumer, protections and court rights that mandatory law provides where you live remain available. These Terms do not require arbitration or waive a right to bring a claim that cannot lawfully be waived.
18. Changes and contact
We will publish updated Terms with an effective date and provide additional notice of material changes as appropriate or required by law. We will request renewed acceptance where required. Revised Terms apply prospectively and do not override mandatory rights concerning earlier transactions. For account, billing or Terms questions, contact help@apexcastai.us.
